Massachusetts requires all citizens who can ‘afford’ health insurance coverage, to purchase coverage by July 1, 2007.
Employers with less than 11 full-time-equivalent employees
- Exempt from most of the employer requirements of the new Health Reform Law.
- May still want to set up Section 125 Plan for their employees because it will reduce taxes for both the employer and the employees.
- Can purchase health insurance through the Health Connector.
Employers with 11 or more full-time-equivalent employees
- Must offer a Section 125 Plan that meets Health Connector regulations. Section 125 Plans let employees save money through pre-tax payments for health coverage.
- Will pay the Free Rider Surcharge if employees or their dependents get medical care that is paid by the state’s Free Care Pool for the uninsured.
- Must make a “fair and reasonable” contribution to their employees’ health insurance or pay a Fair Share Contribution of up to $295 per employee.
- Must file the Employer HIRD information with the annual Fair Share Contribution report and report if they offer a Section 125 Plan that complies with Health Connector regulations
- Must collect an Employee HIRD Form from employees who decline employer-sponsored health insurance or the employer’s Section 125 Plan

Ted Kane is pleased to announce the promotion of Dan Head to the level of Associate. Dan joined 21st Century Benefit Advisors in 2003, shortly after graduation from Hamilton College with a bachelor’s degree in public policy. Over the last 4 years, Dan has supported the firm by performing a number of roles including account management, new business development and managing the firms technology for ourselves and our clients. Dan has earned the CLTC and GBDS designations and is enrolled in the CEBS curriculum. Most recently, Dan has taken the lead role in managing the partnership with and development of our Special Market groups.
